Constitutional structure and position of IHL in domestic law

Armenia is an independent, democratic State based on social justice and the rule of law. The legal system of the Republic of Armenia is the civil law system. Article 6 of the Constitution of the Republic of Armenia, adopted by national referendum on 27 November 2005, states that, upon ratification by the National Assembly (Parliament), international treaties become part of the legal system of the Republic and take precedence over domestic laws and other acts. Should the international treaty be inconsistent with the Constitution, it may be ratified only after the necessary amendments are made to the latter.

Armenia ratified the 1949 Geneva Conventions and both Additional Protocols of 1977 on 7 June 1993.
